Terms & Conditions
The rules for using this website. For appointment, cancellation, and warranty policies, see Salon Policies instead.
Agreement to Terms
By visiting nailtalkspa.com or booking a service through it, you agree to these terms. For how we handle appointments, cancellations, and warranties, see our Salon Policies — this page covers the website itself.
Booking & Appointments
Appointments are booked through Zenoti, our third-party booking platform — clicking Book Now takes you to their site to complete a reservation. Cancellation windows, no-show fees, and deposit terms are covered on our Salon Policies page, not here.
Service times, descriptions, and photos on this site are a general guide — actual appointment length and results can vary by guest.
Payment & Billing Information
When you book an appointment or purchase a gift card or retail product through a payment method we accept — whether directly with us or through Zenoti, our booking and payment partner — you represent that you're authorized to use that payment method, and you authorize the applicable charge, including any taxes or fees.
If a payment method can't be verified or is declined, your booking or order may be suspended or cancelled until it's resolved. If you have a concern about a charge, please contact us directly before disputing it with your card issuer or payment provider — we're glad to sort it out.
Pricing & Availability
Prices shown don't include applicable sales tax or other charges unless we say otherwise in writing. Services and retail products are subject to availability, and we reserve the right to limit quantities, decline all or part of an order, or discontinue a product or service without prior notice — even after you've placed an order or booking.
Prices are subject to change at any time, but a change won't affect an order or booking you've already confirmed. If a product isn't listed on our Shop page or is marked out of stock, it isn't currently available — check back, as our inventory changes.
Website Use
You're welcome to browse and share this site for personal, non-commercial purposes. Copying, republishing, or using our content — photos, copy, design — for commercial purposes without our written permission isn't allowed.
Intellectual Property
The Nail Talk & Spa and Demure Head Spa names, logos, and the photography, copy, and design on this site belong to us and are protected by copyright and trademark law.
Third-Party Services
This site links to and relies on third-party services we don't control — Zenoti for booking, Klaviyo for email offers, and Google/Microsoft tools for analytics (see our Privacy Policy for details). We aren't responsible for the content, availability, or practices of those third-party sites.
Disclaimer; No Warranties
YOU ASSUME TOTAL RESPONSIBILITY AND RISK WHEN YOU USE THIS SITE AND THE INTERNET. THE SITE AND THE CONTENT AND SERVICES MADE AVAILABLE ON IT ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. NAIL TALK & SPA DOES NOT MAKE ANY EXPRESS OR IMPLIED WARRANTIES, REPRESENTATIONS, OR ENDORSEMENTS OF ANY KIND — INCLUDING, WITHOUT LIMITATION, WARRANTIES OF TITLE, NON-INFRINGEMENT, MERCHANTABILITY, OR FITNESS FOR A PARTICULAR PURPOSE — REGARDING THE SITE, ITS CONTENT, OR ANY SERVICES PROVIDED THROUGH IT OR THE INTERNET.
WE MAY CHANGE THE CONTENT, PRODUCTS, OR SERVICES DESCRIBED ON THIS SITE AT ANY TIME WITHOUT NOTICE. WE EXPRESSLY DISCLAIM ALL IMPLIED WARRANTIES. SOME STATES DO NOT PERMIT THE DISCLAIMER OF IMPLIED WARRANTIES, SO THIS DISCLAIMER MAY NOT APPLY TO YOU.
Limitation of Liability
To the extent permitted by law, Nail Talk & Spa isn't liable for indirect or consequential damages arising from your use of this website. This doesn't limit any rights you have under our in-salon service warranties, covered separately in our Salon Policies.
Changes to These Terms
We may update these terms as the site or our services change. Continuing to use the site after an update means you accept the revised terms.
Governing Law
These terms are governed by the laws of the State of South Carolina, without regard to conflict-of-law principles.
Dispute Resolution / Binding Arbitration / Class Action Waiver
Please read this section carefully — it requires you to arbitrate certain disputes and claims with Nail Talk & Spa and limits how you can seek relief from us.
Except for disputes about unlawful use of our intellectual property, or disputes where either party brings an individual claim in small claims court or seeks injunctive relief for unlawful use of intellectual property, you and Nail Talk & Spa waive the right to a jury trial and to have any dispute related to these Terms, or products or services purchased through our site, resolved in court. Instead, such disputes will be resolved through confidential binding arbitration held in Beaufort County, South Carolina, before and in accordance with the Streamlined Arbitration Rules and Procedures ("Rules") of the Judicial Arbitration and Mediation Services ("JAMS"), available on the JAMS website and incorporated here by reference. By using this site, you acknowledge that you've read and understand the JAMS Rules, or you waive any objection to them.
You and Nail Talk & Spa agree that any dispute related to these Terms or to products or services purchased through our site is personal to you and to us, and will be resolved solely through individual arbitration — not as a class arbitration, class action, or other representative proceeding — and will not be consolidated with any other party's claim.
You and Nail Talk & Spa agree that these Terms affect interstate commerce and that this section is governed by the Federal Arbitration Act, 9 U.S.C. § 1, et seq. ("FAA"), to the maximum extent permitted by law. As limited by the FAA, these Terms, and the JAMS Rules, the arbitrator has exclusive authority to decide all procedural and substantive issues and may grant any remedy otherwise available in court — but has no authority to conduct a class or representative arbitration, or to preside over a proceeding involving more than one individual. You and Nail Talk & Spa agree that the state or federal courts located in Beaufort County, South Carolina have exclusive jurisdiction over any appeal or the enforcement of an arbitration award.
Any claim related to these Terms, or to products or services purchased through our site, must be filed within one year after the claim arose, or it's permanently barred — meaning neither you nor we will have the right to assert it.
You have the right to opt out of binding arbitration within thirty (30) days of first accepting this section by emailing us at nailtalkspallc@gmail.com — the opt-out notice must include your full name and clearly state your intent to opt out of binding arbitration. If you don't opt out, you're agreeing to resolve disputes as described in this section.
